Terms & Conditions

1. About Havado

Havado is an online peer-to-peer marketplace where private individuals and businesses can buy and sell second-hand equestrian equipment, tack, apparel, and horses. Havado acts solely as an intermediary platform and is not a party to any transaction between buyers and sellers.


2. Acceptance of Terms

By registering an account or using the Havado platform, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the platform.


3. Eligibility

  • You must be at least 18 years old to register an account on Havado
  • Users under 18 may use Havado to browse, buy, and sell under the supervision and with the explicit consent of a parent or legal guardian, who must create the account and accepts full responsibility for all transactions, communications, and activities conducted through that account
  • Parents or guardians registering on behalf of a minor confirm they have full authority to do so and accept all terms on the minor's behalf
  • You must provide accurate and complete registration information
  • One account per person or business is permitted
  • Havado reserves the right to suspend or terminate accounts at any time

4. Seller Responsibilities

4.1 General Listings

Sellers agree to:

  • Provide accurate, honest, and complete descriptions of all items
  • Upload clear photos that accurately represent the item's condition
  • Disclose all known defects, damage, or faults
  • Set fair and reasonable prices
  • Ship items promptly upon confirmed payment
  • Respond to buyer messages within 48 hours

4.2 Horse Listings

Sellers listing horses additionally agree to:

  • Provide accurate information regarding age, breed, height, gender, and discipline
  • Disclose all known health issues, injuries, and veterinary history
  • Accurately represent the horse's training level and suitability
  • Only list horses that are legally owned by the seller
  • Ensure all passport and microchip information is accurate
  • Disclose any known vices or behavioural issues
  • Not misrepresent competition results or training history

4.3 Prohibited Listings

The following are strictly prohibited on Havado:

  • Stolen goods of any kind
  • Counterfeit or fake branded products
  • Horses with undisclosed serious health conditions
  • Items that are illegal to sell in the Netherlands or EU
  • Any item that infringes intellectual property rights

5. Buyer Responsibilities

Buyers agree to:

  • Read listings carefully before purchasing
  • Pay promptly upon committing to a purchase
  • Inspect items upon arrival and report issues within 48 hours
  • For horse purchases — arrange a veterinary inspection before completing payment where possible
  • Treat sellers with respect in all communications

6. Horse Sales — Special Conditions

Havado strongly recommends the following for all horse transactions:

6.1 Veterinary Inspection Buyers are strongly advised to arrange an independent veterinary inspection (keuring) before completing any horse purchase. Havado accepts no responsibility for health conditions discovered after sale.

6.2 Trial Period Where a trial is agreed between buyer and seller, the terms of the trial must be agreed in writing via Havado messaging before the horse leaves the seller's property.

6.3 Liability

  • Havado is not responsible for the health, behaviour, or suitability of any horse listed on the platform
  • Havado is not responsible for any injury, damage, or loss resulting from a horse transaction
  • All horse sales are between buyer and seller directly — Havado facilitates the introduction only
  • Sellers are solely responsible for the accuracy of all horse descriptions

6.4 Passport & Legal Requirements

  • All horses sold must have a valid EU horse passport
  • Transfer of ownership must comply with Dutch and EU regulations
  • Sellers are responsible for ensuring all legal transfer requirements are met

7. Payments & Buyer Protection

7.1 Buyer Protection Fee A small buyer protection fee is added to each purchase. This fee:

  • Covers payment processing costs
  • Provides a dispute resolution window
  • Is non-refundable once the transaction is completed

7.2 Payment Processing All payments are processed securely via Stripe. Havado does not store payment card details.

7.3 Seller Payouts Sellers receive payment within 5 business days of confirmed delivery. This window allows buyers to verify receipt and condition of items.

7.4 Currency All transactions are processed in Euros (€).


8. Returns & Disputes

8.1 General Items (Tack, Equipment, Apparel)

  • Buyers have 48 hours from delivery to report any significant discrepancy between the listing description and the item received
  • Returns are only accepted if the item significantly differs from its description
  • Buyer and seller are encouraged to resolve disputes directly via Havado messaging
  • If no resolution is reached, Havado may intervene at its discretion

8.2 Horse Sales

  • Horse sales are considered final once the horse has left the seller's property
  • Disputes regarding horse health or suitability must be supported by a veterinary report
  • Havado's dispute resolution for horse sales is limited to facilitation — we cannot guarantee outcomes

8.3 How to Raise a Dispute Contact us at: hello@havado.nl within 48 hours of delivery with:

  • Order reference number
  • Clear description of the issue
  • Supporting photos or documentation

9. Reviews & Ratings

  • After each transaction, buyers and sellers may leave a review
  • Reviews must be honest, fair, and based on the actual transaction
  • Defamatory, offensive, or false reviews will be removed
  • Havado reserves the right to remove reviews that violate these guidelines

10. Fees & Commission

  • Listing on Havado is completely free for sellers
  • Havado charges a buyer protection fee on each transaction (currently 5%)
  • Fees may be updated with 30 days notice to users
  • Havado reserves the right to introduce seller fees in the future with appropriate notice

11. Prohibited Conduct

Users must not:

  • Use the platform for any fraudulent or deceptive purpose
  • Harass, threaten, or abuse other users
  • Attempt to conduct transactions outside the Havado platform to avoid fees
  • Create fake listings or misrepresent items
  • Use automated tools to scrape or access the platform
  • Impersonate other users or Havado staff

12. Intellectual Property

  • All Havado branding, logos, and content are the property of Havado
  • Users retain ownership of their listing content but grant Havado a licence to display it
  • Users must not upload content that infringes third-party intellectual property rights

13. Privacy & Data

Havado processes personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). By using Havado you consent to this processing. Full details are available in our Privacy Policy at havado.net/privacy.


14. Limitation of Liability

To the maximum extent permitted by law:

  • Havado is not liable for any loss or damage arising from transactions between users
  • Havado is not liable for the accuracy of any listing content
  • Havado's total liability shall not exceed the fees paid by the user in the 12 months prior to the claim
  • Havado is not liable for any indirect, consequential, or special damages

15. Governing Law

These Terms & Conditions are governed by Dutch law. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.


16. Changes to Terms

Havado reserves the right to update these Terms & Conditions at any time. Users will be notified of significant changes by email. Continued use of the platform after changes constitutes acceptance.
